These Terms & Conditions (“Terms”) govern your use of HomeServiceDiscounts.com (the “Site”) and the services, offers, emails, and text messages provided by Home Service Discounts (“Home Service Discounts,” “we,” “us,” or “our”). By using the Site, submitting a form, or opting in to our messages, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Please read Section 12 carefully. It contains a binding arbitration agreement and a class action waiver that affect your legal rights.

1. Our Service

Home Service Discounts is a free marketing service that connects homeowners with independent, third-party home service providers (“Service Providers”). We are not a contractor and do not perform, supervise, or guarantee any home services. We are not a party to any agreement between you and a Service Provider.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Site. You agree that the information you submit is true and accurate, and that you are the owner or authorized user of any phone number and email address you provide.

3. Offers and Discounts

  • Offers are provided by participating Service Providers and are subject to availability in your area.
  • Submitting a form does not guarantee that you qualify for an offer or that a Service Provider will be available.
  • Offers may have additional terms, exclusions, and expiration dates set by the Service Provider. Offers may be changed, limited, or ended at any time without notice.
  • Offers have no cash value, cannot be combined with other offers unless stated, and are void where prohibited.
  • Final pricing, scope of work, warranties, and scheduling are agreed directly between you and the Service Provider.

4. Service Providers

Service Providers are independent businesses, not our employees or agents. You are responsible for deciding whether to hire a Service Provider and for verifying their licensing, insurance, and qualifications as required in your area. We do not guarantee the quality, safety, timing, legality, or results of any work performed. Any dispute about services is between you and the Service Provider.

5. Consent to Be Contacted

By submitting your information on the Site and checking the consent box (where shown), you agree that Home Service Discounts and the Service Provider(s) matched to your request may contact you at the phone number and email address you provided, including by calls, prerecorded messages, and text messages sent using automated technology, about your request and related offers. Consent is not a condition of any purchase. You may revoke consent at any time by replying STOP to a text message, by using the unsubscribe link in an email, or by contacting us.

6. SMS / Text Message Terms

  • Program: Home Service Discounts sends recurring automated marketing and informational text messages about home service offers, discounts, and your requests.
  • Opt-in: you opt in by providing your mobile number and agreeing to receive texts on our forms, or by texting a keyword to our number.
  • Message frequency varies. Message and data rates may apply.
  • Opt-out: reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT at any time. You will receive one confirmation message and no further texts unless you opt in again.
  • Help: reply HELP or email info [at] homeservicediscounts [dot] com.
  • Carriers are not liable for delayed or undelivered messages.
  • You agree to tell us right away if you change or give up the mobile number you provided. You agree to indemnify us for any claims caused by messages sent to a number you gave us that does not belong to you.
  • We do not share your mobile number or text opt-in consent with third parties for their marketing. See our Privacy Policy.

7. Email Communications

By providing your email address, you agree to receive emails from us about offers and your requests. You can unsubscribe at any time using the link in any marketing email.

8. Acceptable Use

You agree not to submit false information or information about another person without their permission, use the Site for any unlawful purpose, scrape or copy the Site, interfere with its operation, or try to gain unauthorized access to it.

9. Intellectual Property

The Site and its content, including text, graphics, logos, and images, are owned by or licensed to Home Service Discounts and are protected by law. You may not copy, reproduce, or distribute them without our written permission.

10. Disclaimer of Warranties

THE SITE, OFFERS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY OFFER WILL BE AVAILABLE, THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY SERVICE PROVIDER WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability and Indemnity

TO THE FULLEST EXTENT PERMITTED BY LAW, HOME SERVICE DISCOUNTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM THE ACTS, OMISSIONS, OR WORK OF ANY SERVICE PROVIDER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

You agree to defend, indemnify, and hold harmless Home Service Discounts from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or information you submit.

12. Binding Arbitration and Class Action Waiver

Informal resolution first. Before filing any claim, you agree to contact us by email and try to resolve the dispute informally for at least 30 days.

Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our services, or any calls, emails, or text messages you received from us or on our behalf (including claims under the Telephone Consumer Protection Act or similar laws) will be resolved by final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be held remotely or at a location reasonably convenient to you. The arbitrator may award the same individual relief a court could.

Class action waiver. YOU AND HOME SERVICE DISCOUNTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Opt-out. You may opt out of this arbitration agreement by emailing us within 30 days after you first accept these Terms, stating your name, phone number, and that you opt out of arbitration.

If the class action waiver is found unenforceable, this entire Section 12 will not apply. The rest of these Terms will remain in effect.

13. Governing Law

These Terms are governed by the laws of the Federation of Saint Kitts and Nevis, without regard to its conflict of law rules, except where the law of your place of residence requires otherwise. Nothing in these Terms limits any consumer protection rights you have under the laws of the place where you live.

14. Changes to These Terms

We may update these Terms at any time by posting the revised version on the Site. Your continued use of the Site after changes are posted means you accept them.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
